Arbitration

What is arbitration?

Arbitration is a private trial where the parties choose and hire their judge (arbitrator) based on that person’s experience and subject matter expertise. In most situations, the decision of the arbitrator is final (binding) and not appealable. The decision to use arbitration is usually made in advance by contract prior to any dispute. The dispute resolution provision of the contract outlines the scope of authority of the arbitrator and most often designates a dispute resolution organization to administer the dispute and to set the procedural rules.

David's Experience

David Wells’ neutral dispute resolution activities began in 1983 as a neutral civil case evaluator for Circuit and Probate Courts in the State of Michigan. He continues with that work today. In 1997 he began working as an arbitrator. He regularly arbitrates cases involving very complex issues, multiple parties and potential damages in the millions of dollars. Most of his arbitration work today is through either the American Arbitration Association or the American Health Law Association.
